Actor Will Smith is being sued for sexual harassment by violinist and ‘America’s Got Talent’ contestant Brian King Joseph.
Will Smith Accused of Sexual Harassment
The professional musician filed a complaint against Smith and his Treyball Studios Management, Inc., at the Superior Court of California, County of Los Angeles on Tuesday, December 30, 2025.
According to People, the 33-year-old is alleging a traumatic series of events that took place during Smith’s global tour, ‘Based On A True Story’ in November 2024.
The complaint alleges that after receiving the invitation, Smith “was deliberately grooming and priming Mr. Joseph for further sexual exploitation, and wrongfully terminated.”
Joseph is also claiming an alleged incident in March 2025 during a Las Vegas tour stop, where he claims he found his hotel room–booked by Smith’s team– had been accessed without his consent, claiming evidence of sexual threat of violence of wipes, a beer bottle, HIV medication, and a handwritten note reading,
“Brian, I’ll be back…just us,” with a drawn heart and signed, “Stone F,”
The complaint alleges that a member of the tour management team later “shamed” Joseph and told him he was being terminated. Another violinist was allegedly hired to assume the same position on the tour.
Response from Smith’s Legal Team
On behalf of the actor, Smith’s legal team addressed the claims firmly, denying the allegations and calling them “false, baseless, and reckless.”
“Mr. Joseph’s allegations concerning my client are false, baseless, and reckless. They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”
Joseph is seeking damages for “severe emotional distress, economic loss, reputational harm, and other damages,” including “PTSD and other mental illnesses as a result of the termination.”
