A Washington, D.C. landlord is suing Tyra Banks and business partner Louis Bélanger-Martin, claiming the pair abandoned plans for a “Smize & Dream” ice cream shop. Despite signing a long-term lease in the Eastern Market area, the filing alleges the duo walked away from the project.
The lawsuit outlines a 2024 lease agreement for a 10-year term, designating the space as the flagship for “Smize & Dream.” According to the landlord, Banks and her company abandoned the project, failed to finish construction, and stopped making payments.
In addition to unpaid rent, the lawsuit seeks damages related to lost income, legal fees, and other costs, bringing the total claim to approximately $2.8 million. The complaint portrays the location as more than a simple ice cream shop; it pitched the space as a community hub offering education in hospitality and entrepreneurship.
Banks’ Side– Denial and Motion to Dismiss
Banks and Bélanger-Martin have denied the allegations and have filed a motion to dismiss the lawsuit, arguing that the claims are without legal merit.
The case remains open as the court has yet to issue a ruling. Smize & Dream, which has gained attention for its pop-up activations and unique ice cream concepts, continues to operate in other markets, including locations outside the United States. At this time, representatives for Banks have not issued a public statement beyond the court filings.
